Scriber, LLC (“Scriber,” “we,” or “us”) takes your privacy seriously. This Privacy Policy (the “Policy”), along with our Terms of Service and its incorporated documents, govern your use of our online platform, telecommunications services and other products and services (referred to below simply as the “Services”). Capitalized terms we use in this Policy without defining them have the definitions given to them in the Terms of Service.

What does this Policy cover?

This Policy describes our information collection, storage and disclosure practices regarding how we collect and use personally identifiable information (“Personal Information”). If you are a California resident, the “Your California Privacy Rights” section also applies to you.

This Policy only applies to the processing of your Personal Information by us as a data controller, meaning where we process your Personal Information for our purposes.

What isn’t covered by this Policy?

This Policy does not apply to any processing of your Personal Information by Scriber as a data processor on behalf of a third party provider or a Creator. Creators and Providers have their own privacy practices governing their use of Personal Information, outlined in their own third-party terms.

Creators

First, please note that this Policy does not apply to any Personal Information you share with Creators directly. For information about Personal Information we share with Creators, see “When do you share information with other parties?” below.

Providers

We work with a number of trusted partners who perform vital functions for the Services, including processing payments. These third party providers (“Providers”) allow us to provide the Services to you. Providers include, for example, our Payment Processor, Stripe Inc. Some Providers collect your Personal Information directly, such as Stripe Inc. Others may receive some of your Personal Information when we share it with them.

This Policy only applies to Personal Information we share with Providers, not to Personal Information they may collect directly from you. For information about Personal Information we share with Providers, see “When do you share information with other parties?” below.

When does this Policy apply, and how can I get a copy?

You receive a copy of this Policy when you first subscribe to content from third-party content creators (“Creators”) through the Services. You can always obtain a fresh copy by texting “PRIV” to the phone number through which you access Scriber. Your carrier may charge messaging rates to any text messages you exchange with us.

Will Scriber change this Policy?

We reserve the right to change this Policy at any time. In the event we make changes to this Policy, such policy will be re-posted in the “Privacy” section of our Services with the date such modifications were made indicated on the top of the page or we may contact you to inform you about the revisions with a link to the revised Policy. All changes are effective on the “Last Updated” listed at the top of this page and will apply to all information that we have about you. Your continued use of the Services after any change is posted indicates your acceptance of the changes and your continued consent to our processing of your Personal Information. If at any point you do not agree to any portion of this Policy then in effect, you should immediately stop using the Services. Because this Policy contains legal obligations, we encourage you to review this Policy carefully. What information does Scriber collect?

Scriber collects Personal Information about you when you subscribe to use the Services or provide it to us directly. This may include your name, phone number, email address and physical address. Personal Information is collected by us to provide you with the Services, including when you provide your telephone number to fulfill your Subscriptions, including delivery of links to content through text messages.

What does Scriber use this information for?

We and our third-party providers use Personal Information to: (i) authenticate your identity, your Subscriptions and ensure your access to Posts; (ii) ensure payment for your Subscriptions; (iii) personalize the Services for you; (iv) enable Creators to correspond with you via the Services; (v) guard against fraud and misuse of the Services; and (vi) communicate with you, such as to answers your questions or make promotional offers or surveys available to you.

Finally, as described in our Terms of Service, Posts that you receive as part of your Subscriptions are personal to you, including any Posts you receive as URL links. Posts and URL links may contain data associated with your account. For example, personal URL links contain data associated with your sign-up method – usually your cell phone number. Sharing your personal Posts or URL links violates the Agreement and may disclose your personal information to recipients of your Posts or URL Links.

When do you share information with other parties?

Creators

In order to fulfill your Subscriptions, we share your sign-up contact method (cell phone number and/or your email address) with Creators so that they can communicate directly with you. We do not share any other Personal Information with Creators as a matter of course. Additionally, our agreements with Creators limit their use of Personal Information to those necessary to fulfilling Subscriptions or as otherwise permitted by the Services. For example, we allow Creators to use our Services to send messages targeted to subscribers within particular areas based upon the area code of a subscriber’s cell phone number.

We may remove Creators from the Services if we determine that they misuse Personal Information. Please contact us at [email protected] if you suspect a Creator is misusing Personal Information.

Creators are responsible for the content that they provide you and are responsible for any Personal Information that you provide directly to them or that they receive from us. Scriber does not sell, trade or license Personal Information for marketing purposes or with any entity or individual with whom you do not have a direct relationship, such as a Creator.

Providers

We share information as necessary to enable aspects of the Services provided by Providers, such as hosting, security, content-delivery, customer-support, analytics and computing services.

We do not share Personal Information with Providers unless it is necessary to fulfill our responsibilities, including providing the Services to you. However, in many cases, the information that must share includes Personal Information. For example, in order to enable messaging to mobile phone numbers, we must share those numbers with our messaging Providers.

Other sharing

We may share your Personal Information with law enforcement or other government agencies as required by law or for the purposes of limiting copyright infringement or fraud. We reserve the right to disclose your Personal Information when we believe that disclosure is necessary to protect our rights or comply with legal process. We further reserve the right to disclose any of your Personal Information that we believe, in good faith, appropriate or necessary to take precautions against liability, to investigate and defend against any third-party claims or allegations, to assist government bodies, to protect the security or integrity of the Services, or to protect the rights, property or personal safety of ourselves or other people.

We may share your Personal Information in connection with a corporate reorganization or transaction, such as a divestiture, merger, consolidation, or asset sale, or in the event of bankruptcy.

Non-U.S. Residents

Scriber is only available to residents of the United States with a U.S. phone number. We do not knowingly collect Personal Information from anyone located outside the U.S.

Notifications and Communications from Our Services

Communications Regarding Our Services

If you provided your Personal Information to us, we may send you notifications and other communications from time to time. Some notifications are communications relating to the Services and the Services. You may opt-out of all communications, except for legally required notices, by texting “STOP” to the phone number through which you receive messages from Scriber. Message rates may apply.

Legal or Security Communications

We also send out notices that are required for legal or security purposes. For example, certain notifications are sent for your own protection. In other cases, these notifications involve changes to various legal agreements, such as this Policy or the Terms of Service. Generally, you may not opt out of such communications.

Account and Order Communications

If you subscribe to the Services, we may send you communications regarding our Services and the Services. We may also send communications providing customer support or responses to questions regarding the operation of the Services or Services. Generally, you may not opt out of such emails.

Deleting Your Information

If you want us to delete your Personal Information, please contact us at [email protected] with your request. We will take steps to delete your information as soon as we can, but please note that we must maintain some information for recordkeeping purposes, and as otherwise required by law. We can only delete Personal Information collected and maintained by us. If your Personal Information was provided to a Creator with whom you have a direct relationship, you should contact the Creator regarding deletion of your Personal Information.

Personal Information Retention

We retain Personal Information for as long as a you use the Services, or as long as is necessary to fulfill the purposes for which it was collected, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.

Links to Other Websites

If you follow any links that direct you away from the Services, including links to social media websites, among others, this Policy will not apply to your activity on the other websites you visit. We do not control the privacy policies or the privacy practices of any third party.

Security Policy

We take commercially reasonable steps to protect Personal Information against unauthorized disclosure or loss. However, no data transmission through mobile phone networks or the Internet is 100% secure. Therefore, while we strive to protect Personal Information, we cannot ensure or warrant the security of any information transmitted to us and used for the Services. You engage in such transmissions at your own risk.

You must secure your account and your mobile phone by protecting them appropriately and limiting access to your device.

If you believe your Personal Information is being improperly used by us or any third party, please immediately notify us via email at [email protected].

Your Rights and Obligations

We ask that you keep the Personal Information that you directly provide to us current and that you correct any information you have provided to us by contacting us at [email protected]. You represent and warrant that all Personal Information you provide to us is true and correct and relates to you and not to any other person.

Children Under 13

The Services are not directed to individuals under the age of 13 and children may not create an account or otherwise use Scriber.

Your California Privacy Rights

If you are a California resident, please note that the processing of certain personal data about you may be subject to the California Consumer Privacy Act (“CCPA”) and other applicable California state privacy laws. This section only applies to “you” if you are a California residents.

CCPA provides you with additional rights regarding Personal Information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly with a particular consumer or household. The categories of Personal Information we collect are generally described above, but differ for individual users depending on the Services used by each user.

Under the CCPA, you may have the following rights:

Right to Know and Right to Delete.

You have the right to request that we disclose what Personal Information we collect, use, disclose and sell. You also have the right to submit requests to delete Personal Information.

When we receive a request to know or delete from a California consumer, we will confirm receipt of the request within 10 business days and provide information about how we will process the request, including our verification process. We will respond to such requests within 45 days.

Right for Disclosure of Personal Information.

You may also submit requests that we disclose specific types or categories of Personal Information that we collect.

Under certain circumstances, we will not provide such information, including where the disclosure creates a substantial, articulable and unreasonable risk to the security of that Personal Information, customers’ accounts with us, or the security of our systems or networks. We also will not disclose California consumers’ Social Security numbers, driver’s license numbers or other government-issued identification numbers, financial account numbers, any health insurance or medical identification numbers, or account passwords and security questions and answers.

Verifying Requests

We adhere to a two-step process for all requests for deletion, correction or other action related to information specific to an individual consumer. You must first submit a clear request and then confirm the request.

To submit a clear request, you must provide sufficient information to identify you, such as name, email address, home or work address, or other information that is on record with us so that we can match your submission information to the Personal Information that we maintain. Do not provide Social Security numbers, driver’s license numbers, account numbers, credit or debit card numbers, medical information or health information with requests. If requests are unclear or submitted through means other than as outlined above, we will provide you with specific directions on how to submit the request or remedy any deficiencies. If we cannot verify your identity, we may deny your request.
